New Law in NYS Adds Supplemental Spousal Liability (SSL) Insurance to All New and Renewing Policies

Customers May Choose to Opt-Out in Writing

What is it?

Supplemental spousal liability (SSL) insurance provides bodily injury liability coverage under a motor vehicle insurance policy when a person is injured or killed in a motor vehicle accident caused by the negligence of the person’s spouse. In New York State, it has been optional coverage, added to a policy at the customer’s request.

What’s changing?

Effective August 1, 2023, a new law in NYS requires the addition of supplemental spousal liability (SSL) insurance on all new and renewed automobile policies and commercial auto policies, unless the customer, regardless of their marital status, opts out in writing.

What can you do?

At renewal time, insurance carriers will send an explanation of this change and offer customers the option of accepting or rejecting the added coverage and resulting cost, if any. Carriers may send communications on this topic prior to policy renewal.
